I'm about to buy my first airsoft gun and I'm concerned over legal stuff cause I'm a minor. I've been looking around at some of the topics for laws in California. I didn't find anything convincing so I decided to do some research myself and I finally this. These are the official California Codes. I got them from ca.gov.

California Penal Code Part 4 Title 2 Chapter 6 Article 1 Sections 12550-12556

I thought section 12556 was very interesting, especially part 13 where it gives public-display exemptions to translucent and brightly colored guns! I am not planning to be a serious airsofter (...yet) so those cheap, different color pistols they sell at sporting good stores are fine with me.

So if I play in a creek area that cannot be seen by anyone on the street it is legal? Also Does that mean I cannot put a cover over the orange tip? Or paint over it? a-crazy.gif

If no one can see you, that doesn't make it a legal area. And you only need to orange tip during shipping, otherwise it's legal to have it off.

Not true. PC 12553(a)(1) is interpreted to include the orange tip. Our DA will file on it.

12556 is probably the most restrictive of the laws. I'd say it was put in there to make people play responsibly and decrease the chances of acidental shootings. Most law enforcement actions with regards to these laws are going to be spirit vs. letter, as long as you don't have a bad attitude.

This is christal clear that you must have the orange tip no matter what in CA.

This is a good example of State law that complies with Federal Law.

NY city has complete ban on airsoft guns. But this does not. It's a lot more restrictive than the Federal law, but these should be fine.

It requires airsofter to be 18 years of age. And it requires a sporting event to be certified or regulated.

What's completely out of the hands of this law is the completly toy like guns. Translucent, or in neon colors. Those are so obviously toys, you can display in public. Only display. Not to aim at people or threaten or carry out a bank robbery. Even if it's completely translucent, the bank people falsely believe it to be dangerous, you do the time.


I actually think it's a good law. Kids below 18 should play with completly toy-like guns. Event should be regulated. And airsoft guns should not be flashed in public. Practically that's all this law wants. Anybody with a common sense would follow these anyhow.

I only wish that in the sporting event, on the field only, the orange tip could be covered only during the time of the event. The CA law would be perfect otherwise.

I mean, if you are a sniper, would you crawl around with a blazing orange color rifle tip? But CA law is clear, any obstruction of any effort to remove or cover the blazing orange color is illegal. But fields are private fields, that means if no one calls police to that field, police cannot enter without permission or warrent. So people do what they want, which may not be legal.

It's kinda like your parents letting you have a sip of champaign or beer when you are underage. It's illegal, but hey, it's a one time thing, and you don't have a police in your house, so who's going to know? People do that kind of illegal things.

Sorry to say but that's equivalent to saying you can smoke marijuana in your home and the police can't enter because they don't have permission. The fact of the matter is if they have reasonable proof or see you with the gun without the tip they have every right to enter the property and take advantage of the law. It would be a different situation if you had orange tips and it was an organized event you wouldn't be breaking the law.

Lol I live in a small town (everyone sees everything) me and my first airsoft friends that started our airsoft boom would play at this house that had a big front yard that was in clear view of our towns main road. and when I mean main road im talking about 1500 people all in the hills and this one road going through town...anyways point of my story at night the police would come almost every time some of them draw there guns others are cool with it but we never ever got into trouble. the only thing those stupid liberal bastereds can do is fine us for litering assuming they saw us shoot onto the road.

So we know Ca blows and we have to have our orange tips while we play on fields in the public but what about other state do they have the same rules?? Or are they a little better and not so A_NAL???

Private fields do not require Orange tips. Many professionally run skirmishes do not require an orange tip...

Ok I wanna see if what I do is legal lol. Me and my friends were all 18. We go to this public field (its like a deep hole in the middle of a bunch of houses) with airsoft guns that are clear or have orange tips in the dead of night. We wear safty stuff. If the cop ever came up to us can they do anything?

If you play in CA they can cite you for 12556, $100 the first time. Time of day would play a role. You would probably just be told to knock it off.

bottom of the line is take the orange tip off at your own risk. I myself have done it but I suggest that u know the laws and if you are ever questioned about it know what you are going to say. the CA law contradicts itself about requiring an orange tip:

"12553. (a) (1) Any person who changes, alters, removes, or
obliterates any coloration or markings that are required for by any
applicable state or federal law or regulation, for any imitation
firearm, or device described in subdivision © of Section 12555, in
any way that makes the imitation firearm or device look more like a
firearm is guilty of a misdemeanor."


[b]This section pretty much says that if your gun came with an orange tip, then not to mess with it or you are going to jail. if confronted by a police officer one could make the argument that they purchased the airsoft gun off craigslist or something and an orange tip was not included. 12555 ©.

"12555 © As used in this section, "imitation firearm" does not include
any of the following:
(1) A nonfiring collector's replica that is historically
significant, and is offered for sale in conjunction with a wall
plaque or presentation case.
(2) A BB device, as defined in subdivision (g) of Section 12001."

"12001 (g) For purposes of Sections 12551 and 12552, the term “BB device” means any instrument that expels a projectile, such as a BB or a pellet, not exceeding 6mm caliber, through the force of air pressure, gas pressure, or spring action, or any spot marker gun."

In these two sections it goes into detail about what is and is not an imitation firearm. the argument could be made that an airsoft gun is a "bb device" and as such does not need to be sold with an orange tip as it does shoot bb's, the bb's are less then a 6mm caliber, and in the case of gas and spring guns they are shot through the force of air pressure, gas pressure or spring action.

this argument can not be made for automatic electric rifles or electric pistols


if you are going to take the orange tip off it might not be a bad idea to reference these when being questioned by the police.

Question: Recently I went to the park to shoot my airsoft gun. Note my airsoft gun is TRANSLUCENT and has a bright orange tip and a bright lime green handle. Now a group of guys were threatening to call the cops on me even though I was in an area that was explicitly public. Nevertheless I left not wanting to get in any trouble from the police and not fully aware of what the airsoft laws here in CA and I'm not a confrontational person. My question is, was I breaking any laws or were they just giving me a hard time?

Need to know should I ever want to shoot my airsoft gun anywhere other than inside my house. -___-
